These Terms of Service ("Terms") govern your use of our website located at pawpal.app and our mobile application (collectively, the "Service") operated by PawPal ("us," "we," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

2. Acceptance of Terms

By creating an account, accessing, or using PawPal's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Service.

3. Eligibility

To use PawPal, you must:

5. User Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. You are responsible for:

• Maintaining the confidentiality of your account and password.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.
• Ensuring that you exit from your account at the end of each session when using a shared or public computer.

Failure to comply with these requirements constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

6. Subscription and Payment Terms

PawPal offers both free and paid subscription plans:

• Free Plan: Limited features are available at no cost.
• Premium and Household Plans: Paid subscriptions with additional features.
• Free Trial: Premium plans may include a free trial period. You will be charged after the trial period ends unless you cancel before the trial expires.
• Billing: Subscriptions are billed on a monthly or annual basis, as selected. All fees are non-refundable except as required by law.
• Price Changes: We reserve the right to modify subscription prices. We will provide notice of price changes, and you may cancel your subscription if you do not agree to the new pricing.
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

7. Content and Intellectual Property

The Service and its original content, features, and functionality are owned by PawPal and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you upload to PawPal, including pet information, photos, and documents. By uploading content, you grant PawPal a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing the Service to you.

8. Prohibited Content

You agree not to upload, post, or transmit any content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Infringes upon the rights of any third party, including intellectual property rights.
• Contains viruses, malware, or other harmful code.
• Violates any applicable laws or regulations.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to delete your account.

10. Limitation of Liability

In no event shall PawPal, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Service.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. PawPal makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. We do not warrant that the Service will be uninterrupted, secure, or error-free.

PawPal is a pet care management tool and is not a substitute for professional veterinary care. The information provided through our Service, including reminders and checklists, is for informational purposes only and should not be considered medical advice. Always consult with a licensed veterinarian for medical decisions regarding your pet's health.

13. Indemnification

You agree to defend, indemnify, and hold harmless PawPal and its licensees and licensors from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which PawPal operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
